Warranty Terms and Conditions

of dot-lines UG (limited liability)

1. Voluntary Manufacturer's Warranty

  1. dot-lines UG grants a voluntary manufacturer's warranty of two, three or five years from the date of delivery for selected products.

  2. The applicable warranty period is specified in the product catalogue, product data sheets or product documentation of dot-lines UG valid at the time of delivery.

  3. If no warranty period is specified for a product in the product catalogue, data sheets or product documentation valid at the time of delivery, no manufacturer's warranty shall apply.

  4. This manufacturer's warranty is provided voluntarily and in addition to any mandatory statutory or contractual warranty rights, where applicable.

2. Warranty Conditions

Warranty claims are subject to the following conditions:

  • Full payment of the respective delivery.

  • Professional installation by qualified personnel.

  • Use of the product in accordance with the applicable technical specifications, installation instructions and operating manuals.

  • Compliance with all specified operating and environmental conditions.

  • Use of suitable power supplies, control units and accessories approved for the respective product.

  • Proper maintenance and care of the product.

  • Correct storage, installation and use of the product.

No warranty claim shall exist where the reported defect results from failure to comply with any of the above conditions.

3. Product Performance and Normal Ageing

LED products are subject to natural ageing. In particular, luminous flux, brightness and light colour may change over the service life of the product.

Any lifetime ratings published in product catalogues, data sheets or technical documentation, including L-values, B-values or comparable technical specifications, represent technical reference values determined under defined laboratory and reference conditions. They do not constitute a guarantee of product characteristics, service life or maintained luminous flux under actual operating conditions.

The following shall not constitute warranty cases:

  • Normal reduction of luminous flux.

  • Changes in light colour or colour temperature.

  • Colour variations within industry-standard and technically unavoidable tolerances.

  • Variations between different production batches.

  • Individual LED failures within the technically accepted failure rate.

A warranty claim shall only exist where the functional impairment can be proven to result from a material or manufacturing defect.

The assessment shall be based on the technical inspection carried out by dot-lines UG or by a testing body appointed by dot-lines UG.

4. Scope of Warranty

At its sole discretion, dot-lines UG shall fulfil its warranty obligations by:

  • Repairing the product.

  • Supplying replacement parts.

  • Supplying an equivalent replacement product.

  • Supplying a technically comparable successor product.

There shall be no entitlement to delivery of an identical product.

Warranty performance shall be fulfilled exclusively by providing replacement material ex warehouse of dot-lines UG. No on-site services are included.

This warranty does not establish any right to reimbursement, refund of the purchase price, price reduction, contract cancellation or compensation for damages.

5. Warranty Exclusions

The warranty does not cover, in particular:

  • Normal wear and natural ageing affecting luminous flux, brightness or light colour.

  • Colour deviations within industry-standard and technically unavoidable tolerances.

  • Damage resulting from improper installation, storage, handling or use.

  • Mechanical damage, including cuts, bends, crushing or tensile stress.

  • Damage caused by moisture, condensation, corrosion or chemical influences.

  • Damage caused by overvoltage, undervoltage, voltage fluctuations, power supply disturbances or lightning.

  • Damage resulting from unsuitable or non-approved power supplies, control units or other components.

  • Damage caused by overheating or insufficient heat dissipation.

  • Damage resulting from inadequate heat dissipation through suitable cooling surfaces, aluminium profiles or heat sinks.

  • Damage caused by permanently elevated ambient temperatures or other unsuitable operating conditions.

  • Modifications, repairs or alterations carried out by unauthorized persons.

  • Damage caused by force majeure.

  • Damage caused by fire, water, storms, vandalism or other external influences.

6. Costs Not Covered by the Warranty

The warranty is limited exclusively to the warranty services described in Section 4.

The warranty expressly excludes all additional expenses and costs, including but not limited to:

  • Removal and reinstallation costs.

  • Dismantling and installation costs.

  • Commissioning and programming costs.

  • Transportation and shipping costs.

  • Express freight or special transportation costs.

  • Packaging costs.

  • Travel, accommodation and incidental expenses.

  • Costs of external service providers.

  • Costs for scaffolding, lifting platforms, cranes or access equipment.

  • Costs for opening and restoring ceilings, walls, floors or other building structures.

  • Inspection, testing and expert assessment costs.

  • Temporary replacement lighting.

  • Production downtime.

  • Business interruption.

  • Loss of use.

  • Delays to construction or installation projects.

  • Contractual penalties.

  • Indirect or consequential damages of any kind.

  • Loss of profit.

7. Warranty Procedure

Warranty claims must be submitted in text form without undue delay after the defect has been discovered.

The claimant shall provide appropriate evidence supporting the alleged defect, including where applicable:

  • Photographs.

  • Videos.

  • Installation records.

  • Operating hour records, where available.

  • Order or invoice numbers.

  • Batch numbers or production markings.

  • Any other documentation required for proper technical assessment.

dot-lines UG reserves the right to request that the allegedly defective product be returned for technical inspection.

As a general rule, there shall be no entitlement to advance replacement, advance delivery or replacement prior to completion of the technical inspection.

Different arrangements may be agreed on a case-by-case basis, particularly where access to the installed product would require considerable effort.

No warranty service shall become due before completion of the technical inspection.

If the inspection reveals no material or manufacturing defect, or if the claim does not fall within the scope of this warranty, the claimant shall bear all inspection, shipping and processing costs incurred.

8. Limitation of Liability

The maximum liability arising from this warranty shall be limited to the original net invoice value of the respective product.

Regardless of the number of warranty claims asserted, the total liability of dot-lines UG for any individual project shall be limited to the net order value of the respective delivery.

Liability for indirect damages, consequential damages, financial losses, production downtime, loss of use, project delays, loss of profit or third-party claims is excluded.

9. Availability of Replacement Products

If the originally supplied product has been discontinued, is no longer available or has become technically obsolete at the time the warranty claim is processed, dot-lines UG shall be entitled to supply a technically comparable replacement or successor product.

There shall be no entitlement to an identical design, identical technical specification, identical light colour, identical luminous flux or identical lighting characteristics, provided that the essential product characteristics and intended functionality are maintained.

10. Scope of Application

These warranty terms apply exclusively to businesses, commercial customers, distributors, processors, general contractors, architects, planners and other business customers within the meaning of Section 14 of the German Civil Code (BGB).

These warranty terms do not apply to consumers within the meaning of Section 13 of the German Civil Code (BGB).

11. Final Provisions

This warranty is a voluntary undertaking by dot-lines UG.

Should any provision of these Warranty Terms become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the economic purpose of the original provision.

These Warranty Terms shall be governed by the laws of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

To the extent permitted by applicable law, the exclusive place of jurisdiction for all disputes arising out of or in connection with this warranty shall be the registered office of dot-lines UG.
